This is controlled by the founder of the channel. See /ChanServ help SET MEMO
for example
/chanserv set #channel5 MEMO NONE ! disable completely
/chanserv set #channel5 MEMO FOUNDER ! only founder can send chan memos
/chanserv set #channel5 MEMO AOP ! any AOP can send a channel memo
